Ohio and West Virginia residents injured by exposure to the notorious toxic chemical ‘C8’ may be entitled to compensation for their injuries by filing a C8 lawsuit. A recent epidemiological study has identified a disturbing link between C8 exposure and cancer (thyroid, kidney & testicular), ulcerative colitis, pregnancy-induced hypertension, and other serious health complications. Compensation from C8 lawsuits is intended to help victims with medical bills, lost wages, pain and suffering, and other damages.
C8 Lawsuit Update 1/23/13: Earlier this month, DuPont submitted a request to consolidate nearly 30 federal environmental tort lawsuits filed over its controversial Teflon manufacturing agent perfluorooctanoic acid (commonly known as ‘C8’) into a multidistrict litigation (MDL). The C8 lawsuits were filed on behalf of Ohio and West Virginia residents who were either seriously injured or killed after drinking water contaminated with the dangerous chemical, which was released from DuPont’s Washington Works Plant in Parkersburg, West Virginia prior to 2004. The company filed the petition to consolidate the claims so as to reduce duplicative discovery, to avoid conflicting rulings from different judges, and to move things through the litigation process as quickly as possible.

The History of C8
For nearly a half century, DuPont Chemical used a product known as ammonium perfluorooctanoate (referred to in the industry as PFOA or C8) to manufacture Teflon at its Washington Works Plant in Parkersburg, West Virginia. Unfortunately, the Teflon manufacturing process resulted in huge amounts of C8 being released into the air and water surround the plant. Dupont then disposed of additional quantities of the chemical in surrounding landfills and in the nearby Ohio River. As a result, the following water districts tested positive for C8 contamination:
- Little Hocking, Ohio
- Lubeck Public Service District, West Virginia
- City of Belpre, Ohio
- Mason County Public Service District, West Virginia
- Tuppers Plains, Ohio
- Village of Pomeroy, Ohio
C8 Side Effects
People who drank or bathed in water from any of these facilities between the 1950’s and December 2004 are at risk for developing one or more of the following complications:
- thyroid disease
- kidney cancer
- testicular cancer
- ulcerative colitis
- pregnancy-induced hypertension
- other serious health complications
It is important to understand that it does not matter where you live now. If you resided within one of the areas listed above, and consumed or bathed in water for one year or more, you may have been exposed to excessive levels of C8.
If you were exposed to C8
In 2005, a class action settlement was enacted to set aside monies for medical monitoring expenses and a number of other remediation damages. The class action also allows for a process whereby plaintiffs can hire a lawyer to represent them for their individual personal injuries. If you suffered a serious injury that you believe may have been caused by C8 exposure, or if a loved one died after drinking water from one of the plants listed above, contact the C8 lawyers at Schmidt & Clark, LLP, today to discuss your legal options. If we determine that you have a valid claim, our lawyers will handle your case on a contingency fee basis, which means that there are never any costs to you unless we achieve a favorable outcome in your case.
